Avoid Costly Mistakes in Dividing Retirement Assets

One of the most common—and most costly—areas for mistakes in divorce is the division of retirement assets.

This is especially true when a private, state, or federal pension is involved.

Pensions and the legal documents used to divide them—Qualified Domestic Relations Orders (QDROs) and Domestic Relations Orders (DROs)—are highly technical. The language used in these documents directly determines what each party ultimately receives.

Even small errors or omissions can significantly change the outcome.

How QDRO and DRO Mistakes Happen

Many people assume that receiving “50%” of a retirement account or pension is straightforward. In reality, the outcome depends entirely on how the agreement and the QDRO/DRO are written.

Without proper drafting, you may receive far less than expected.

This can happen due to:

  • Ambiguous or incomplete language in the separation agreement
  • Failure to address both pre-retirement and post-retirement survivor benefits
  • Misunderstanding which portion of the benefit is subject to division
  • Lack of coordination between the agreement and the QDRO/DRO

In many cases, these issues are not discovered until years later—when benefits are about to be paid. At that point, it may be too late to correct them.

Ensuring the Agreement Matches the Outcome

When I am engaged to prepare a QDRO or DRO, my first priority is to ensure that everyone clearly understands what is being divided and how it will be divided.

If the language in the separation agreement does not accurately reflect the intended outcome, I work with attorneys to clarify and revise that language before the order is finalized. This step is critical to avoiding problems later.

I then draft the QDRO/DRO to ensure that it:

• Accurately reflects the terms of the agreement
• Addresses all relevant benefits available to the participant
• Covers both pre-retirement and post-retirement scenarios
• Complies with plan requirements to avoid rejection or delays

Protecting Both Parties in the Division Process

A properly drafted QDRO or DRO protects both the Participant and the Alternate Payee.

My process is designed to ensure that:

• The division is implemented exactly as negotiated
• All available benefits are clearly addressed
• There are no unintended gaps or ambiguities
