List of Required Documentation Needed for Divorce Financial Analysis
This is not a complete list and depending on your situation, additional documentation may be requested. If you have any questions, please do not hesitate to ask. Depending on your situation, I may not need all 3 years worth of certain documents. Please note SCREEN SHOTS are NOT Acceptable
Financial Statement:
- Both parties’ completed Financial Statement, known as Rule 401
- Long Form if income is $75,000 or over http://www.mass.gov/courts/docs/forms/probate-and-family/cjd301longform.pdf
- Short Form if income is under $75,000 http://www.mass.gov/courts/docs/forms/probate-and-family/cjd301shortform.pdf
Income:
- 3 years of Federal Tax Returns – I typically do not need State returns
- 3 years of each parties’ W2s, 1099s, K1s, etc.
- 3 years Corporate Tax Returns (1120 or 1120s), if applicable
- 3 years Partnership Returns (1065), if applicable
- If sole owner of a business, YTD Profit and Loss and Balance Sheet
- 3 most recent pay stubs for each spouse
- Employee Handbook showing all benefits, perks, etc.
- Employer/Employee Contract and Compensation Agreements
- Social Security Benefit Statement (http://www.ssa.gov/retire/estimator.html)
Assets – Non-Retirement:
- Balances in Checking/Savings/Money Market accounts – may not need actual statements if listed on Financial Statement
- Balances in CDs – may not need actual statements
- Most recent statements for any brokerage accounts – non-retirement accounts
- Includes stocks, bonds and mutual funds and any other owned equity investments
- Balances in any HSA (Health Spending Account), FSA or Section 125 Cafeteria Plans
- Stock Options and other Equity Compensation – if you have any of these, special documentation is required, please ask for complete list
- Incentive Stock Options (ISO)
- Non-Qualified Stock Options (NQSO)
- Restricted Stock Units/Shares (RSU)
- Performance Stock Units (PSU)
- Any other joint or individually owned investment asset
- Information on Life Insurance policies – Term, Whole Life with Cash Value balance
- Education accounts – 529s, UTMA and UGMA custodial accounts
Assets – Retirement:
- Most recent statements for all employer-sponsored 401(k), 403(b), 457 plans
- Most recent statements for all IRA and Roth IRAs
- Pensions – State and Federal – Benefit Estimate from Retirement Board
- Pensions – Private – Plan document and Benefit Estimator from HR
- Any other retirement plans and deferred compensation not listed above
Liabilities:
- Most recent mortgage/HELOC statements for all properties owned, incl. the annual real estate tax amount and the Homeowners Insurance premium amount
- Student Loan statements with payment/terms
- Auto Loan statement and all auto insurance premiums for all cars
- 401(k) loans
- Personal loans
